By accessing the website, you confirm your understanding, acceptance and agreement to these Terms and Conditions. If you do not agree to these Terms and Conditions of use, you must not use this website. The website reserves the right to change, modify, add, or remove portions of these Terms and Conditions at any time. Changes will be effective and posted on the website and no other notice shall be provided. It is strongly recommended to check these Terms and Conditions regularly for updates. The continued use of the website following the posting of changes to the Terms and Conditions constitutes your acceptance and agreements of those changes.
Use of the website: we grant you a non-transferable and revocable full licence to use the website under these Terms and Conditions. The purpose of the website is explicitly stated on the homepage. Commercial use by any third party except as explicitly agreed with us in advance, is prohibited. Any breach of these Terms and Conditions shall resulting the immediate revocation of the licence granted without notice to you. All content provided on the website is only as an informational service. Property representations and associated products/services detailed on the website are those of brokers/agents/private sellers and are not made by us excepting HouseAndHome.ph Subscription services. Brokers/agents/private sellers and providers of associated products/services are wholly responsible for the accuracy and legality of their respective content posted on HouseAndHome.ph

Should you register or subscribe for any services provided by HouseAndHome.ph, you agree to provide accurate and current information about yourself and to update information if there are any changes. Every user of the website is solely responsible in keeping their password and other account identifiers safe and secure. Any registered user is effectively an account owner and is entirely responsible for all activities that occur under such password or account. You agree to notify us of any unauthorised use of a password or account immediately you are aware of such occurrence HouseAndHome.ph shall not be responsible or liable, directly or indirectly in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with these Terms and Conditions. During the registration process you agree to receive promotional emails from the website. You can subsequently unsubscribe from receiving such promotional emails by clicking on the Unsubscribe link at the bottom of any promotional email.
Illegal Activity And/Or Abuse
HouseAndHome.ph and its service providers work to ensure our websites and services are working properly and the online community is kept safe. Please report any problems regarding offensive content and any policy breaches in these Terms and Conditions to us. We work to ensure no content infringes copyright, trademark or other intellectual property rights of third parties. If you believe that your intellectual property rights have been infringed, please notify us immediately so we can investigate.
Anything that you submit to HouseAndHome.ph and/or provide to us, including but not limited to questions, reviews, comments and suggestions (collectively known as the submissions) will become our sole property and shall not be returned to you. In addition to the rights applicable to any submission, any post, comment or review to the side also grant us the right to use the name that you submit in connection with such reviews comment or other content. You shall not use false email addresses, pretend to be someone other than yourself or otherwise mislead us or third parties as to the origins of any submissions. We may, but shall not be obligated to, remove or edit any submissions. Publication of submissions are solely at the discretion of HouseAndHome.ph.
Subscriptions and Listings
Subscriptions entitles the subscriber to submit listings for publication to a maximum number commensurate to the subscription paid. Submission of listings for publication does not guarantee their publication. All listings submitted are manually checked to ensure they meet HouseAndHome.ph minimum standards which are set to ensure the optimum website user experience which will in turn enhance a professional perspective of brokers, agents & private sellers and increase the likelihood of gaining a client. Specifically, (but not exclusively), the following standards shall apply:
- All listings shall be accompanied by a minimum of one quality photograph.
- All listings must include direct contact details of the broker/agent/private seller.
- No property may be listed by more than three brokers/agents/private sellers at any one time.
- No property may be listed simultaneously by the same broker/agent/private seller.
When a subscription is due for renewal, a courtesy reminder email will be sent to the subscriber a minimum of 24 hours before the subscription expires. On the renewal date, our payments partner, PayPal automatically debits the subscription charge due using the payment method selected by the subscriber on initial subscription. It is the responsibility of the subscriber to ensure that the payment details are kept up to date. Should payment be declined for any reason then the listings associated with the subscription will be automatically suspended until payment is received.
HouseAndHome.ph shall have the right to terminate or suspend any subscription without refund if the subscriber breaches these Terms and Conditions. Any decision to suspend or terminate a subscription shall be communicated to the subscriber in an email notice and/or txt message using the contact details registered. Termination of the subscription shall not be finalised until at least seven days after such intention has been communicated to the subscriber to allow the subscriber the opportunity to explain and/or remedy the breaches. Any suspension of a subscription shall automatically become a termination should the subscriber not rectify the breach within 28 days of being notified of the suspension. Termination of subscription will also terminate user registration and reregistration of the same name, email address or contact telephone number shall not be permitted for a minimum of 12 months commencing from the date of termination.
Third Party Links
The website may include hyperlinks to other sites operated by third parties. Links to third-party sites include, without limitation, links to the sites of some of subscribing real estate agency brokers and agents. Those third-party sites do not form part of this website are not under the control of, or the responsibility of HouseAndHome.ph when you click a link to the sites you leave our website do so entirely at your own risk houseandphone.ph makes no warranty as to the accuracy or reliability information on any third-party sites and houseandhone.ph and its directors, officers and employees disclaim all liability and responsibility for any direct or indirect loss or damage which may be suffered by you relying on anything contained on or omitted from such third party sites.
You will indemnify and hold us, and our officers, directors, harmless from any claim or demand including reasonable attorney’s fees made by any third party due to or arising out of your breach of these Terms and Conditions or your violation of any law or the rights of third party.
No agency, partnership, joint-venture, employee-employer relationship is intended or created by this agreement.
We shall send notices to you by email to the email address you provided during the registration process. Notices shall be deemed given 24 hours after the email is sent, unless the sending party is notified of the email address being invalid. Alternatively, we may give you legal notice by registered mail to the address (if any) provided during the registration process. Notices sent to you by registered mail shall be deemed to have been received by that party three days after the date of mailing.
In addition to any other legal or equitable remedies, we may, without prior notice to you immediately terminate the Terms and Conditions or revoke any or all of your rights granted under these Terms and Conditions. Upon any termination of this agreement you shall immediately cease all access to and use of the website and we shall, in addition to any other legal or equitable remedy, immediately revoke all passwords and account identifications issued to you and deny your access to and use of the website in whole or in part. Any termination of this agreement cannot affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination. You furthermore agree that the website shall not be liable to you or to any other person as a result of any such suspension or termination. If you are dissatisfied with the website or with any Terms and Conditions, policies, guidelines or practices your sole and exclusive remedy is to discontinue using the website.
Limitation of Liability
To the extent permitted by law, our liability for breach of any implied warranty or condition that cannot be excluded is restricted, at our option to: the resupply of services or payment of the cost of the resupply of services as provided by this website.
In no event shall HouseAndHome.ph be liable to you or any third-party for any indirect, consequential, exemplary, incidental, special or punitive damages, including (but not exclusively): – lost profit, loss of revenue, loss of goodwill, loss of customers, loss of capital, downtime costs, loss of profits, loss of or damage to reputation, loss under or in relation to any other contract, loss of data, loss of use of data, loss of anticipated savings or benefits suffered or incurred by you under or in any way connected with this agreement or the website. Notwithstanding anything to the contrary herein, the aggregate liability of HouseAndHome.ph its related entities and to you for any cause of action whatsoever and regardless of the form of the action, will at all times be limited to US $100.
If a dispute arises between you and HouseAndHome.ph our aim is to provide you with a neutral, cost-effective and fair means of resolving the dispute. Accordingly, you and HouseAndHome.ph agree that we will resolve any claim or controversy at law or equity that arise out of this agreement or the services in accordance with one of the subsections below or as we and you otherwise agree in writing. Before resorting to these alternatives, we strongly encourage you to first contact us directly to seek a resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as arbitration as alternatives to litigation.
Applicable Law And Jurisdiction
- These Terms and Conditions shall be interpreted and governed by the laws in force in the Republic of the Philippines. Subject to the arbitration section below, each party hereby agrees to submit to the jurisdiction of the courts of Republic of the Philippines and to waive any objections based upon the venue.
- Any controversy, claim or dispute arising out of or relating to these Terms and Conditions will be referred to and finally settled by private and confidential binding arbitration for a single arbitrator held in Republic of the Philippines in English and governed by Republic of the Philippines’ law pursuant to the rules of commercial conciliation and arbitration of 1994, as amended, replaced or re-enacted from time to time. The arbitrator shall be a person who is legally trained who has experience in information technology field in the Republic of the Philippines is independent of either party. Notwithstanding the foregoing, the website reserves the right to pursue the protection of intellectual property rights and confidential information through injunctive or other equitable relief through the courts.
